Flexi Driver does not itself provide driving, transportation or chauffeur services.

04 · DRIVER INFORMATION
Information Should Be Accurate.
Drivers are responsible for providing truthful, complete and reasonably up-to-date information when creating or maintaining a profile.
Drivers must not knowingly provide false, misleading, fraudulent or materially incomplete information about their identity, experience, licence, availability or other profile details.
05 · VERIFICATION
Verified Does Not Mean Guaranteed.
Verification is intended to support profile authenticity and user trust. It is not a guarantee of future conduct or service quality.

CUSTOMER RESPONSIBILITY

07 · DRIVER RESPONSIBILITY

Drivers are responsible for applicable licences, permits, insurance and vehicle documents.

Drivers remain responsible for their own actions and conduct while providing services.

DIRECT DEALINGS
From Contact to Agreement, You Deal Directly.
Discussions about employment, salary, working hours, service, pricing, availability, travel arrangements or other conditions take place directly between the customer and the driver.
Flexi Driver is not a party to that private arrangement and does not supervise or manage it.
09 · PAYMENTS
Money Matters Stay Between Customer & Driver.

Flexi Driver does not collect or process payments made between customers and drivers.
Directly
Salary, service fee, advance, deposit, refund or other financial arrangements are made directly between the parties.
Commission
Flexi Driver does not charge commission on payments made by customers to drivers.

11 · REAL-WORLD RISKS
When Real Life Gets Involved, Responsibility Matters.

Driving incidents and road-related events.
Injury
Personal injury or loss arising from service.
Property
Damage or loss of vehicles and belongings.
Flexi Driver does not control the driver's conduct or service delivery and is not responsible for such consequences except to the extent applicable law provides otherwise.

12 · MISCONDUCT
No Place for Fraud or Unlawful Conduct.
Theft, fraud, cheating, harassment, assault, misuse of property, identity fraud, financial fraud or other unlawful conduct is not authorised or permitted through Flexi Driver.
Persons engaging in such conduct remain responsible for their actions and may be removed from the platform and, where appropriate, reported to the relevant authorities.

14 · PLATFORM PROTECTION
Our Liability Is Limited Where the Law Allows.
To the maximum extent permitted by applicable law, Flexi Driver shall not be liable for indirect, incidental, special, consequential or punitive losses arising from interactions, arrangements or disputes between users and drivers.
This includes losses relating to accidents, injury, property damage, financial loss, service failure, misconduct or disputes, except where such limitation is not permitted by law.

15 · INDEMNITY
Your Dealings. Your Responsibility.
To the extent permitted by applicable law, users agree to indemnify and hold harmless Flexi Driver, its owners, operators, representatives and associated personnel from claims, losses, damages, liabilities, costs or expenses arising from their own conduct, misuse of the platform, or dealings and disputes with other users or drivers.
This does not exclude liability that cannot lawfully be excluded.

17 · LAWFUL USE
Use the Platform Responsibly.
Users must not use Flexi Driver for unlawful, fraudulent, abusive, threatening or deceptive purposes.

18 · LEGAL COMPLIANCE
When the Law Requires It, We Cooperate.
Flexi Driver may cooperate with government authorities, law-enforcement agencies, courts or other competent authorities when required or permitted under applicable law.
19 · LEGAL FRAMEWORK
Governed by Indian Law. Siliguri as the Forum.
These Terms shall be governed by and interpreted in accordance with the laws of India.
Subject to applicable law, disputes arising directly between Flexi Driver and a user in relation to these Terms or the use of the platform shall be subject to the jurisdiction of the competent courts having territorial jurisdiction in Siliguri, West Bengal, India.
To the extent legally permissible, the parties intend Siliguri, West Bengal to be the exclusive forum for such disputes.

Flexi Driver may update these Terms from time to time to reflect changes in the platform, business model, applicable law or operational practices.

Flexi Driver was founded by Mrinal Pramanik, a small business owner from Siliguri, West Bengal.
Flexi Driver was created from a simple observation: finding a driver should not always require going through an agency or accepting a driver without knowing enough about the person beforehand.
The platform was built to give customers more visibility, more choice and a direct way to connect with drivers. Drivers can also create their presence on the platform and connect with people looking for their services.
Flexi Driver is independently developed and operated. Its purpose is to provide a platform for discovering driver profiles and facilitating direct connections, while the actual hiring decision and service arrangement remain between the customer and the driver.

Flexi Driver is an independent online driver listing platform. It helps users discover driver profiles, review available information and connect directly with drivers. Flexi Driver does not itself provide driving, chauffeur or transportation services.
No. Listing a driver on Flexi Driver does not create an employer-employee, agency, partnership or joint-venture relationship between the driver and Flexi Driver. Drivers listed on the platform act independently.
No. Verification is intended to support the authenticity and reliability of profile information, but it is not a guarantee of a driver's future behaviour, driving ability, safety, availability, service quality or criminal history.
Customers should make their own reasonable checks before hiring a driver, including identity, driving licence, experience, availability, pricing and any other credentials or information they consider relevant to their requirements.
Drivers are responsible for their own driving, conduct, legal compliance and service delivery. Flexi Driver does not control or manage the driver's actual service. Responsibility for accidents, injuries or property damage will be determined according to the circumstances and applicable law.
Any person who commits theft, fraud, cheating, harassment, assault or other unlawful conduct is responsible for their own actions. Such conduct is not permitted on the Flexi Driver platform. Flexi Driver may remove or suspend profiles and cooperate with lawful authorities where required or permitted by law.
Hiring decisions, service terms, availability, pricing, salary, advances, deposits and other payment arrangements are agreed directly between the customer and the driver. Flexi Driver does not currently collect or process such customer-driver payments.
No. Flexi Driver does not guarantee a driver's availability, punctuality, suitability, driving performance, safety, service quality, pricing or future conduct. Customers and drivers are responsible for making their own decisions before entering into any arrangement.
Yes. Flexi Driver may suspend, restrict or remove a profile where there is inaccurate information, misuse of the platform, unlawful activity, misconduct or a violation of the applicable platform rules and Terms & Conditions.
Any hiring arrangement or service relationship is directly between the customer and the driver. Flexi Driver is not a party to that arrangement. Users are responsible for resolving disputes arising from their direct dealings, subject to applicable law and the rights available to them.
To the maximum extent permitted by applicable law, Flexi Driver's liability is limited as described in the Terms & Conditions. The platform does not assume responsibility for matters arising from direct dealings between users and drivers except where liability cannot lawfully be excluded or limited.
The Terms & Conditions are governed by the laws of India. Subject to applicable law and where legally permissible, disputes relating to Flexi Driver are intended to be subject to the jurisdiction of the competent courts having territorial jurisdiction in Siliguri, West Bengal, India.
